This course reviews the statutes and rules that govern broker duties, outlines the kind of policies and procedures manual a broker needs as part of exercising control and surveys a number of important policies a broker needs to be developed as part of the supervisory and control process. It will also describe major features of short sales, covering the financial circumstances of the parties involved and the question of whether a short sale is appropriate for them. It explains the agent’s role in working with short sale buyers and sellers, surveys the contents of a short sale package to be submitted to a lender, and discusses some special legal concerns with short sales. It will provide a quick overview of major aspects of property management and reviews the laws that govern property management activities in general and the handling of trust funds in particular. This course will help property managers to understand what a lease is, what it conveys, how different leases function, how their terms are specified, and how they can be terminated. It also reviews the Department’s enforcement powers and processes and examines actual cases in which these powers were applied.

While the number of work-related deaths and injuries in the real estate profession are relatively low, they do exist. Think about it: real estate licensees often meet complete strangers by themselves, in vacant properties, at odd hours, with little or no background information on the prospect. When you think about our profession in this way, the job can sound dangerous. We can reduce this risk with some basic safety protocols. Even if your brokerage has a set of security procedures, there are additional steps you can take to keep yourself and your clients safe. In this course, we will see how taxes impact buying and selling real property. The federal government taxes individuals and other entities based on their earnings by means of a progressive income tax. In a progressive tax, the more you earn, the higher your tax rate. The important consideration of a progressive tax is that the taxpayer’s obligation increases as income increases, moving the taxpayer to higher tax brackets. One of the reasons for buying real estate is to get relief from taxes.

The tax benefits of homeownership differ from those available to owners of investment property. The legal reduction of tax liability, otherwise known as a tax shelter, is available to all owners of a primary residence as well as to a taxpayer owning investment property. However, different rules apply to each type of property. The rules must be followed carefully to earn the desired tax shelter.

Will interest rates rise? Will it be a seller’s or a buyer’s market? Will affordable new homes come on the market? By studying the current indicators and trends economists and real estate analysts are able to provide relevant economic forecasts to navigate the maze of future uncertainty. However, regardless of how much and effort is put into forecast, at the end of the day a forecast is just a prediction and is basically the equivalent of an educated guess.

This course provides an overview of various forecasts and predictions made for the real estate market in 2023 and describes adaptive reuse and accessory dwelling units. Additionally, it provides a review of economic cycles and the economic theory of supply and demand, which is the backbone of real estate markets.

Everyone seems to be talking about implicit bias and diversity. Implicit bias is the attitudes or stereotypes that affect an individual’s understanding, actions, and decisions in an unconscious manner. Businesses offer training on it, politicians support it, the media extols it. But what exactly is implicit bias and diversity? Unfortunately, some real estate agents let their biases get in the way of working with people from diverse cultures. However, successful licensees realize that working with people from diverse cultural backgrounds creates an opportunity for business and possibly personal relationships.

Biases, preferences, attitudes, stereotypes, and prejudices are all examples of psychological constructs. Psychological constructs are mental associations that can influence a person's behavior and feelings toward an individual or group. If the person is unaware of these mental associations, the biases, preferences, attitudes, stereotypes, or prejudices are said to be implicit.

Having biases or preconceived feelings is normal human behavior. Everyone has biases of one kind or another. It’s okay to have different likes and dislikes. Biases are harmless as long as they are about unimportant things, like preferring Pepsi over Coke (or vice-versa for you Coke lovers). But when we hold prejudices against other people, and then act on those prejudices in an illegal discriminatory way, we create all kinds of problems.
 

This course will take you through all the subjects mandated by the California Department of Real Estate, and includes instruction in Federal
and State fair housing laws relating to the sale and rental of real estate, selected Federal and State civil rights and anti-discrimination laws
relating to real property transactions and business establishments, the voluntary affirmative marketing agreement (VAMA) and its application
in the real estate industry, and how to avoid practices that could be considered discriminatory in commercial and residential transactions and facilities.
 

The course will examine seven specific topic areas: ethics, agency, fair housing, trust fund handling, risk management, management and supervision, and implicit bias. Both national and California-specific laws and legislation for each subject area will be discussed and the relevance to real estate agents explained. The various ways in which an agency relationship may be established, the types of relationships, and some features of agency agreements will be examined as well. Students will be introduced to those sections of the California Business and Professions Code that deal with ethical practices as well as the differences between business and personal ethics. The organizations responsible for enforcing Fair Housing will be examined as well as some of the penalties that a violator may face. The course will also discuss the proper procedures for opening and maintaining trust accounts. Students will explore what agents can do to assess the areas which present the highest risk to them, how to prepare for those risks and ways to shift risk to other professionals in the real estate industry. Further, we’ll review information pertinent to the proper management and supervision of a brokerage firm. Finally, the concept of implicit bias will be explored and strategies to improve interactions with diverse communities will be provided.
